From Initial Contact to Receiving Your Settlement

At The Cycling Solicitors, we’re passionate about standing up for injured cyclists. Whether you’ve been knocked off your bike by a careless driver, injured by a road defect, or involved in a hit-and-run, we’re here to guide you every step of the way. Here's how we take your claim from your first call to your final compensation.

 

Step 1: Free Initial Consultation

Your journey begins with a no-obligation, free consultation. We’ll ask about:

  • How your accident happened
  • The nature of your injuries
  • Any damage to your bike and gear
  • The financial impact (e.g. lost earnings, treatment costs)

We’ll give you honest, clear advice on whether we believe you have a claim – and explain your options.


Step 2: Starting Your Claim

If you choose to go ahead:

  • We’ll open your file and explain our conditional "No Win, No Fee" fee agreement
  • We’ll begin gathering key documents: Police report, medical records, and photographs
  • We’ll notify the defendant (e.g. the driver or their insurer) that we are acting on your behalf

Step 3: Evidence Gathering

We take care of collecting the evidence to support your claim, including:

  • Medical reports
  • Witness statements
  • CCTV or helmet cam footage
  • Quotes for bike repair or replacement
  • Documentation in respect of lost earnings or other losses

Step 4: Independent Medical Examination

To value your injuries accurately, we’ll arrange for you to see a specialist medical expert. They will:

  • Assess your injuries and recovery progress
  • Provide a formal medical report
  • Identify future treatment needs
  • Provide a prognosis

This report forms the foundation for your injury valuation, known as general damages for pain, suffering and loss of amenity.


Step 5: Negotiation with the Defendant or Insurer

Once we have full medical and financial evidence, we will:

  • Send a formal schedule of loss together with medical evidence to the other side
  • Begin negotiating your compensation for both general damages (pain and suffering) and special damages (financial losses)

Most of our claims are settled without going to court.


Step 6: Interim Payments (If Needed)

If you are struggling financially (e.g. unable to work or need urgent treatment), we can request interim payments – a part payment of your compensation paid before the final settlement.


Step 7: Settlement or Court Proceedings

  • If the other party accepts liability and we agree on a figure for general damages and special damages, your case is settled and payment follows within weeks.
  • If they dispute liability or offer too little, we may issue court proceedings. We will represent you throughout and aim to resolve your claim without a trial – though we’re fully prepared to go to court if needed.

Step 8: You Receive Your Settlement

Once a settlement is agreed:

  • You’ll receive a breakdown of the final figure
  • If you’ve had interim payments, they will be deducted from the final figure
  • You will then receive your settlement by bank transfer
